एक प्रतिष्ठित सरकारी अधिकारी ने भारतीय शासन व्यवस्था के बारे में बेहतरीन बात कही थी, ‘यह तीन इंजनों से चलती है- पीएम, सीएम, डीएम (प्रधानमंत्री, मुख्यमंत्री और जिला मजिस्ट्रेट)।’ मैं उन्हें इस सटीक टिप्पणी का श्रेय दूंगा लेकिन साथ ही अपना विवेक भी इस्तेमाल करूंगा। और चाहूंगा कि मैं जो तर्क पेश कर रहा हूं उसका दोष उन्हें न दिया जाए।
इस महामारी के दौरान सरकारों ने ‘एपिडेमिक डीजीजेज़ एक्ट’ और ‘डिजास्टर मैनेजमेंट एक्ट’ का सहारा लेकर जो विशेष शक्तियां हासिल कर ली हैं, वे इस पुरानी टिप्पणी को प्रासंगिक बना देती हैं। अब हमें विचार की जरूरत है कि सार्वजनिक स्वास्थ्य की इस आपातस्थिति में इस तीन स्तरीय तानाशाही ने भारत का कुछ भला किया या नहीं? या इसके उलटे नतीजे ही निकले हैं, खासकर असंगठित कामगारों के मामले में?
पिछले छह वर्षों में किसी मंत्री को ज्यादा बोलते नहीं सुना गया। संभवतः अमित शाह को छोड़कर। कैबिनेट सिस्टम बेअसर हो चुका है। सामूहिक जिम्मेदारी, आंतरिक विचार-विमर्श, असहमति बेमानी बना दिए हैं। नोटबंदी जैसा फैसला मंत्रिमंडल से लगभग गुप्त रखकर किया जाता है। ऐसा नहीं है कि इंदिरा गांधी के मंत्रिमंडल में असहमति की बहुत गुंजाइश रहती थी, लेकिन यह तथ्य भी पीएम-सीएम-डीएम निजाम वाले तर्क को मजबूत ही करता है। गठबंधन सरकारों के दौर में भी क्षेत्रीय स्तर पर तानाशाहियां उभरी थीं और सत्ता का इस्तेमाल पसंदीदा नौकरशाहों के जरिए होता रहा है।
इस महामारी ने उस ‘एपिडेमिक डीजीजेज़ एक्ट’ को लागू करना जरूरी बना दिया, जिसे अंग्रेजों ने 1897 में प्लेग महामारी के दौरान बनाया था। अब ‘आपदा प्रबंधन कानून’ से यह और मजबूत हो गया है। सुनामी के बाद इस कानून को बनाते समय यूपीए ने इसके इस हश्र की कल्पना नहीं की होगी। आज महामारी से केंद्र सरकार को सारे अधिकारों का केंद्रीकरण करने का कानूनी आधार मिल गया है। कैबिनेट सेक्रेटरी राज्यों के मुख्य सचिवों की बैठक करें इसमें असंवैधानिक कुछ नहीं, मगर फिर लोकतांत्रिक तरीके से निर्वाचित नेताओं का क्या होगा?
यहां एक विरोधाभास उभरता है। अगर दो कानूनों और संसद में बहुमत ने पीएम के हाथों में इतने सारे अधिकार सौंप दिए हैं, तो सीएम कहां हैं? और फिर, ‘तीन इंजन’ वाले फॉर्मूले का क्या होगा? भारत के राजनीतिक नक्शे पर नजर दौड़ाइए। सर्वशक्तिमान केंद्र के नीचे कई मिनी तानाशाहियां भी पनपती हैं। इसका किसी एक ही पार्टी से लेना-देना नहीं है। तेलंगाना और आंध्र प्रदेश में क्षेत्रीय दल के सर्वशक्तिमान मुख्यमंत्री हैं। प. बंगाल में अकेली ममता का शो जारी है। ये सब अपने-अपने तरीके से केंद्र से सहयोग या असहयोग करते रहे हैं।
केंद्र और राज्यों में सर्वशक्तिमान हुए लोगों के बीच जो एक नया राजनीतिक इकरारनामा जैसा हुआ है, वह दिलचस्प है। ऐसे में कुछ भाजपाई सीएम के लिए अफसोस होता है, खासकर शिवराज सिंह चौहान और विजय रूपाणी के लिए, जिन्हें मामूली अधिकारों के भरोसे छोड़ दिया गया है। लेकिन भाजपा में भी, योगी आदित्यनाथ और बी.एस. येदियुरप्पा अपने आप में शक्तिशाली हैं। विधानसभा में महज 20% सीटों के साथ पिता-पुत्र की तानाशाही इस संकट के सामने अनाड़ी जैसी दिख रही है। वे इसमें दिग्भ्रमित दिख रहे हैं।
अब हम डीएम पर आते हैं। जिस तरह पीएम अधिकारियों की टास्कफोर्स के जरिए कोरोना से राष्ट्रीय जंग लड़ रहे हैं, उसी तरह सीएम अपनी टास्कफोर्स के जरिए लड़ रहे हैं। केंद्र में यह व्यवस्था इस हद तक मजबूत हो गई है कि यह जरूरी नहीं माना जाता कि इससे जुड़े स्वास्थ्य, गृह, कृषि और श्रम जैसे अहम विभागों के मंत्री राष्ट्र से सीधे बात करें। इसका गंभीर नतीजा यह है कि जिन लोगों को जमीनी हकीकतों की सतही जानकारी है, वे आदेश जारी कर रहे हैं।
इस प्रशासनिक ढांचे में किसी ने अनुमान नहीं लगाया था कि चार घंटे के नोटिस पर सम्पूर्ण लॉकडाउन से क्या समस्याएं पैदा होंगी और प्रवासी कामगारों के मन में क्या डर बैठ सकता है। कामगारों को आयात और निर्यात करने वाले राज्यों ने भी अनुमान नहीं लगाया। यह इसीलिए हुआ कि नेतृत्व सहज राजनीतिक बुद्धि को भूल गया या सब कुछ डीएम जैसों के ऊपर छोड़ दिया। लॉकडाउन का पहला चरण पूरा होने तक मामला हाथ से निकलता दिखा। और जहां ऐसा हुआ वहां देखिए कि किसे जिम्मेदार ठहराया गया।
महाराष्ट्र और गुजरात में राजधानियों के नगर निगमों को संभाल रहे आईएएस अधिकारियों को हटा दिया, क्योंकि वे ‘बहुत ज्यादा’ टेस्टिंग कर रहे थे। बिहार, मप्र ने अपने स्वास्थ्य सचिव बदल दिए। इस पूर्णतः संवैधानिक तथा वैध तीन स्तरीय तानाशाही के तहत इस महामारी का जिस तरह मुकाबला किया गया उसके नकारात्मक नतीजे दिखने लगे हैं।

A distinguished government official had said the best about the Indian governance system, 'It runs with three engines - PM, CM, DM (Prime Minister, Chief Minister and District Magistrate).' I would give him credit for this exact comment but at the same time I will also use my conscience. And would like not to blame them for the argument I am presenting.
The special powers that governments have acquired during this epidemic by resorting to the 'Epidemic Diseases Act' and the 'Disaster Management Act' make this old comment relevant. Now we need to consider whether this three tier dictatorship did anything for India in this public health emergency? Or have the opposite been achieved, especially in the case of unorganized workers?
In the last six years, no minister has been heard to speak much. Except possibly Amit Shah. The cabinet system has been neutralized. Collective responsibility, internal discussions, disagreements have been made meaningless. The decision like demonetisation is made almost secretly from the Cabinet. It is not that there was much scope for disagreement in Indira Gandhi's cabinet, but this fact also reinforces the logic of PM-CM-DM Nizam. Even during the era of coalition governments, dictatorships had emerged at the regional level and power has been exercised through preferred bureaucrats.
This epidemic made it necessary to implement the 'Epidemic Diseases Act', which was created by the British during the plague epidemic in 1897. Now it is further strengthened by the 'Disaster Management Act'. The UPA would not have imagined its fate when the law was enacted after the tsunami. Today the epidemic has given the Central Government the legal basis to centralize all rights. Cabinet Secretary should meet Chief Secretaries of the states There is nothing unconstitutional in this, but then what will happen to the democratically elected leaders?
Here a contradiction emerges. If two laws and a majority in Parliament have handed over so many rights in the hands of the PM, then where is the CM? And then, what will happen to the 'three engine' formula? Look at the political map of India. Many mini dictators also flourish under the almighty center. It has nothing to do with any one party. The almighty chief minister of the regional party in Telangana and Andhra Pradesh. P. Mamta's single show continues in Bengal. All these have been cooperating or non-cooperation from the center in their own way.
It is interesting that a new political contract has taken place between the people who have been omnipotent in the Center and the states. In such a situation, there is regret for some BJP CMs, especially Shivraj Singh Chauhan and Vijay Rupani, who have been relinquished on minor rights. But even in BJP, Yogi Adityanath and B.S. Yeddyurappa is powerful in himself. The father-son dictatorship, with just 20% seats in the assembly, looks clumsy in the face of this crisis. They look dazed in it.
Now we come to the DM. Just as the PM is fighting the national war against Corona through the task force of the officers, similarly the CM is fighting through his task force. This system has been strengthened at the Center to such an extent that it is not necessary that ministers of important departments like Health, Home, Agriculture and Labor connected to it talk directly to the nation. The serious consequence of this is that those who have superficial knowledge of ground realities are issuing orders.
In this administrative set up, no one had anticipated what problems would arise from the complete lockdown on four hours notice and the fear of migrant workers. The states that imported and exported the workers also did not anticipate. This happened because the leadership forgot the instinctive political intelligence or left everything to the DM. The case appeared to be out of hand until the first phase of the lockdown was completed. And where it happened, see who was held responsible.
In Maharashtra and Gujarat, the IAS officers handling the capitals of the capitals were removed, as they were doing 'too much' testing. Bihar, MP replaced his health secretary. The way the epidemic was fought under this completely constitutional and legitimate three-level dictatorship has started showing negative results.
